1. Definitions

1. In these general terms and conditions, the following definitions shall apply:

General Terms and Conditions

These general terms and conditions applicable to all quotations and agreements with EBTG for the rental of a Bike.

Bike

The (cargo) bicycles and/or electric (cargo) bicycles specified in the quotation, including accessories such as helmets, panniers, etc.

EBTG

The private limited liability company EBTG B.V., lessor of Bikes and Containers.

Renter

The natural person aged 18 years or older who rents Bikes from EBTG.

Damage Coverage

A subscription for renting a Bike under which the Renter is not liable for damage to the Bike and EBTG applies a deductible in the event of theft in accordance with Table 1.

A subscription for renting a Bike under which the Renter is not liable for damage to the Bike and EBTG applies a deductible in the event of theft in accordance with Table 1.

MyBike

The personal online environment in which the Renter can amend personal details, report damage or theft, contact EBTG or cancel the agreement.

2. Registration and Agreement

1. These General Terms and Conditions apply to all quotations, agreements and services provided by EBTG.
2. An agreement is concluded via the online registration form at
   ridenoord.com and/or
   ebiketogo.com.
3. The agreement is concluded upon payment of the first instalment or when EBTG starts executing the agreement at the Renter’s request.
4. The Renter is responsible for keeping personal data up to date in MyBike.
5. Failure by EBTG to strictly enforce any provision does not constitute a waiver of rights.

3. Subscription

1. When entering into the agreement, the Renter selects a Bike subscription including damage coverage and optional theft coverage.
2. The Renter may choose a fixed or flexible subscription term. A fixed term cannot be cancelled during that period. A flexible term is cancellable monthly.
3. After expiry of the fixed term, the subscription is automatically converted into a flexible term with a 4‑week notice period.
4. If the Bike is returned within 7 days after the start of the subscription (trial week), rental costs will be refunded. This is possible once per Renter.

4. Fees and Payment

1. The Renter owes the agreed rental fee and additional costs in advance. All amounts are inclusive of VAT.
2. EBTG reserves the right to adjust prices due to changes in legislation or annual indexation. Price changes are announced at least one month in advance.
3. Payment is made via direct debit. If collection fails, EBTG may disable motor assistance and terminate or dissolve the agreement.
4. In the event of payment arrears, EBTG may engage a collection agency and recover statutory interest and costs.

5. Delivery

1. EBTG undertakes to make the Bike available as agreed.
2. Delivery and collection cost €50. Collection and delivery at an EBTG service point are free of charge.
3. If the Renter is not present at the agreed time and location, €50 will be charged.
4. Appointments may be changed or cancelled up to 24 hours in advance.

6. Obligations of the Renter

1. The Bike may only be used in accordance with its intended purpose and with due care.
2. Subletting, lending or transferring the Bike is not permitted.
3. The Bike must be returned in the same condition as received. Modifications are not permitted.
4. The Renter must properly secure the Bike against theft using the locks provided by EBTG.

7. Service and Maintenance

1. Routine maintenance is carried out by EBTG.
2. Third‑party repairs are not permitted without EBTG’s consent.
3. Damage or theft must be reported within 24 hours via MyBike.

9. Duration and Termination

1. The agreement is entered into for an indefinite period unless otherwise agreed.
2. Termination by the Renter is possible with a notice period of 4 weeks via MyBike only.
3. If the Bike is not returned on time, EBTG may classify this as theft.

10. Dissolution

1. This article does not affect EBTG’s statutory right to dissolve the agreement.
2. Upon dissolution, the Bike must be returned within two days.

11. Privacy

1. Personal data are processed in accordance with applicable privacy legislation.
2. The Bike may be equipped with GPS; location data is used anonymously.

12. Ownership

1. All Bikes remain the property of EBTG.

13. Liability

1. EBTG is only liable for damage it is legally obliged to compensate.
2. Any compensation is limited to the amount actually paid by the insurer plus any deductible.

14. Governing Law and Jurisdiction

1. All agreements are governed exclusively by Dutch law.
2. Disputes shall be submitted exclusively to the competent court in Amsterdam.

15. Amendments

1. EBTG is entitled to amend these General Terms and Conditions in accordance with the law.
